The below terms of use are for the official website (“Site”) of Heart of Midlothian Football Club (the “Club”). This website is operated by ClubStreamTV (Stellar Omada Ltd) on behalf of the Club.
By accessing, or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree with any part of these Terms, you must not use the Service.

Content and usage restrictions

Content ownership
The content and materials on the Service and the software used to provide the Service are the property of, or are under licence to, The Club and Stellar Omada Ltd. You have no rights in the Content other than the limited right to stream it as permitted by these Terms. 

Copyright and Trademarks
All content on this Site, including copyrights and trademarks, is owned by The Club and Stellar Omada Ltd or their licensors. You cannot copy or reproduce any of it. You may only use this content if you have express written permission from The Club and Stellar Omada Ltd (or their licensors) or if its use is explicitly allowed in these terms. You agree not to help anyone else copy, reuse, or commercially exploit the content. Please notify us immediately if you become aware of any unauthorised use.

Trademarks and service marks on this Site belong to The Club and Stellar Omada Ltd or their licensors. You are not allowed to use or reproduce any of these marks without written permission from The Club and Stellar Omada Ltd.

Content usage
You agree to use this Service strictly for personal purposes to purchase goods or services. 

Restrictions
You agree not to:

  • Share your account login credentials with any other person or household
  • Copy, record, reproduce, redistribute, transmit, sell, or modify any Content
  • Use the Service or any area of the Site for any commercial purpose without the prior written consent of The Club and Stellar Omada Ltd. No business or commercial entity may register for or use the service for any commercial purposes without the prior written consent of Stellar Omada Ltd.
  • Create a link (of whatsoever nature) to the Site without the prior written consent of The Club and Stellar Omada Ltd. Consent to the creation of a link to the Site from The Club and Stellar Omada Ltd should not be taken to be either express or implied consent to use any of the content or materials that appear on the Site. 
  • Use a Virtual Private Network (VPN) to alter your IP location and in order to allow live streaming within the UK & Ireland. Stellar Omada Ltd monitors for this activity and reserves the right to block accounts found to be violating this term.
Acceptable use and user conduct

Your responsibility
You must use the Service for lawful purposes only. You are prohibited from posting or introducing any martial or content to the Site that is illegal, harmful, offensive, or infringing on others’ rights. 

Prohibited content includes, but is not limited to, anything that is (in our judgment):

  • Illegal or promotes illegal activities.
  • Abusive, obscene, defamatory, or racist.
  • Pornographic or sexually explicit.
  • Harmful to minors (people under 18).
  • Spam (junk mail or unsolicited mass mailings).
  • Infringes on the rights of any person or organisation.
  • Commercial in nature without prior consent.

The Club and Stellar Omada Ltd reserves the right to remove any prohibited material or content at any time and without notice.

Content you submit
Any material or content you send to or post on the Site (other than Personal Data) will be treated as non-confidential and non-proprietary. This means:

  • You give up any rights to claim that our use of the material infringes on your rights (including moral rights).
  • The Club and Stellar Omada Ltd may use your submitted material in any way, without time limit, throughout the world, and without liability for any royalties or fees.

Third-Party Data and Security
You must not submit any content containing a third party’s personal or financial data unless you have their express written consent.

You acknowledge that the internet is not completely secure, and any content you send to the Site may be intercepted by others.

Disclaimer
The Club and Stellar Omada Ltd accept no liability for any material or content submitted by users and published on the Website.

Suspension of termination of your use of the site

The Club and Stellar Omada Ltd have the right to stop your use of the Site if you break these Terms. They can also take any necessary legal steps to uphold this decision.

Subscriptions, billing and cancellation

Subscription
Hearts TV is a recurring subscription-based product with both monthly and annual subscription options available.  You are charged monthly or annually on the date you subscribe, depending on the subscription model you choose. 

Billing
By starting your subscription, you authorise us to charge you a subscription fee at the then-current rate, plus any applicable taxes, on a recurring basis, using the payment method you provided. 

Cancellation
You can cancel your subscription at any time before your next billing date, and you will not be charged again unless you restart your subscription. You can continue to use the service until the end of your current billing period. No refunds are available on subscriptions during the service period.

At certain times during the season, Pay Per View (PPV) matches may be offered through the live stream service which can be purchased by members who do not have a subscription.  No refunds are available for PPV purchases.

Service Suspension and Interruption

The Club and Stellar Omada Ltd reserve the right to suspend or stop any service or access to the Site itself for technical, legal, or regulatory reasons. We will provide notice of such actions whenever possible.

You accept that computer and telecommunication services are not perfect and will require occasional periods of downtime (for repair, maintenance, or upgrading). The Club and Stellar Omada Ltd cannot guarantee uninterrupted availability, and you will have no claims regarding any period when the Site is unavailable.

User indemnity

You agree to indemnify (protect and pay) The Club and Stellar Omada Ltd against all losses, damages, costs, expenses, and liabilities (including legal fees) that we incur or are awarded against us. This covers any claims arising from your use of this Site, including creating a link to the Site or introducing content or material to it.

Disclaimer and limitation of liability

The Club and Stellar Omada Ltd are not responsible for any material or content posted on the Site by a third party.

We do not guarantee or warrant that the material or content on the Site is accurate, complete, or current, or that your use of the Site will be free from defects, including viruses or other harmful elements.

Limitation of Liability: To the maximum extent permitted by law, The Club and Stellar Omada Ltd will not be liable to you for any indirect, consequential, special, incidental, or punitive damages. This includes, but is not limited to, loss of profits, business, or data, even if we were advised that such loss was possible. This limitation does not affect your statutory consumer rights.

Changes to terms of use

The Club and Stellar Omada Ltd reserves the right to revise and change these Terms at any time. We will provide notice of material changes by posting the new Terms on the Service or by sending subscribers an email notification. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

The Club and Stellar Omada Ltd further reserves the right, at any time, to charge you for accessing certain materials on this Site and/or to make access to certain materials on the Site conditional on you agreeing to additional terms and conditions.

Governing law

These Terms and Conditions are exclusively governed by and interpreted in accordance with Scottish law. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the Scottish courts.
